A will is generally an instrument whereby a person provides for the disposition of his property after death and includes a “codicil” (an amendment to the Will) and any testamentary instrument which appoints an executor (to administer the Will) or revokes or revises as another Will. It must be executed in accordance with the formalities required by California law. A will becomes effective only upon your passing. A will can designate guardianships for minor children, individuals to receive inheritance, and individuals to administer your will and your estate. We assist clients in reviewing or drafting wills and ensure proper language usage to avoid misinterpretation. What kind of will do you need? Every person should have a will to avoid the potential risk that their property may pass by intestacy and a simple will may be all that is needed for a moderate estate. When spouses draft wills, they generally leave their assets to each other. If the other spouse does not survive, then they leave their assets to their children. If they have minor children, this type of will allows them to nominate a guardian for the children and a trustee for their children’s property as well as specify the age when their property will be distributed to them.
